Digital Guides Terms of Purchase
These Terms of Purchase explain the terms that apply to your purchase and use of Divine Flame’s Digital Guides, including the Catholic nature of the materials, important use restrictions, and the final-sale terms that govern digital products.
Please read these Terms of Purchase carefully before completing your order. By purchasing, downloading, accessing, or using any digital guide, worksheet pack, template, checklist, or other downloadable product from Divine Flame (“Digital Product”), you agree to the terms below.
1. Scope
These Terms of Purchase govern your purchase and use of Digital Products offered by Divine Flame Coaching & Consulting, LLC (“Divine Flame,” “we,” “us,” or “our”).
2. Nature of Digital Products and Catholic Perspective
Digital Products are offered for educational and informational purposes only. They are designed to provide practical guidance and moral clarity on reproductive ethics, pregnancy complication support, prenatal diagnosis navigation, special-needs parenting preparation, and related topics from the Catholic perspective.
You do not need to be Catholic to purchase a Digital Product. However, by purchasing or using a Digital Product, you acknowledge that Divine Flame creates its Digital Products from the Catholic perspective, and you agree to receive them on that basis.
Digital Products do not constitute medical advice, diagnosis, treatment, or medical care; legal advice or legal representation; psychotherapy, counseling, psychiatric care, or crisis intervention; or individualized professional advice for your specific circumstances.
Your purchase or use of a Digital Product does not create a clinician-patient, therapist-client, attorney-client, fiduciary, or other professional relationship with Divine Flame.
3. Personal Responsibility
You remain solely responsible for your own decisions, actions, follow-up, and use of the information provided. You should consult appropriate licensed professionals, clergy, or other advisors regarding your specific situation.
4. No Guarantee
Divine Flame makes no guarantee regarding outcomes, decisions, diagnoses, emotional effects, family experiences, or any result arising from your use of a Digital Product. Examples, illustrations, decision tools, scripts, and checklists are provided for educational purposes only.
5. Price and Payment
All prices are listed in U.S. dollars unless otherwise stated. Payment is due at checkout. Any tax required by applicable law may be added at checkout.
You authorize Divine Flame and its payment processor to charge the payment method you provide for the total purchase amount.
6. Final Sale / No Refunds
Because Digital Products are delivered immediately, made available for download, or otherwise become accessible upon purchase:
A. all sales are final; and
no refunds, returns, exchanges, or cancellations are provided once access has been granted or the product has been delivered, except where required by law.
Delivery or access is deemed complete when the Digital Product is made available for download, sent by email, or otherwise provided through the checkout or delivery platform.
If you believe you were charged in error, please contact Divine Flame before initiating a chargeback or payment dispute. Divine Flame reserves the right to provide relevant purchase records, delivery records, policies, and communications to the payment processor or financial institution in response to a dispute.
7. License and Permitted Use
When you purchase a Digital Product, Divine Flame grants you a limited, non-exclusive, non-transferable, revocable license to use that product for your own personal, non-commercial use within your immediate household only.
Unless expressly authorized in writing, you may not:
A. copy, reproduce, republish, upload, post, distribute, or publicly display the product;
share the product outside your immediate household;
sell, sublicense, resell, or commercially exploit the product;
modify the product and distribute derivative versions;
remove copyright, trademark, or proprietary notices; or
use the product in a way that suggests endorsement, affiliation, or authorship by you or a third party.
use the product to create, market, sell, or distribute a competing guide, worksheet, course, coaching resource, consulting resource, or other derivative product or service.
8. Intellectual Property
All Digital Products, including their text, structure, branding, design, frameworks, worksheets, scripts, checklists, resource packs, and accompanying materials, are owned by or licensed to Divine Flame and are protected by applicable intellectual property laws.
9. Technology and Access
It is your responsibility to ensure that you have the device, software, internet access, and file-viewing capability necessary to access the Digital Product.
Divine Flame does not guarantee uninterrupted access to download links, platforms, or third-party services. If you experience a technical issue with delivery, contact us within a reasonable time, and Divine Flame will make reasonable efforts to assist with access.
10. Not for Emergencies
Digital Products are not intended for emergency use or crisis situations. If you are experiencing a medical, psychiatric, or other emergency, call 911 or seek immediate professional assistance.
11. Third-Party Resources
A Digital Product may reference third-party resources, providers, articles, or websites for convenience and informational purposes. Divine Flame is not responsible for the content, accuracy, availability, or policies of third-party resources.
12. Limitation of Liability
To the fullest extent permitted by law, Divine Flame shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising out of or related to your purchase or use of a Digital Product.
To the fullest extent permitted by law, Divine Flame’s total liability relating to a Digital Product shall not exceed the amount you paid for that product.
Nothing in these Terms excludes liability that cannot lawfully be excluded.
13. Governing Law
These Terms of Purchase are governed by the laws of the State of New York, without regard to conflict-of-law principles.
14. Entire Agreement
These Terms of Purchase, together with any applicable website policies and checkout terms presented at the time of purchase, constitute the entire agreement relating to your purchase and use of the Digital Product.
If there is a conflict between these Terms of Purchase and any general website policy, these Terms of Purchase control as to the Digital Product.
15. Acknowledgment
By completing your purchase, you acknowledge that you have read, understood, and agree to these Terms of Purchase.
